Applicability of this Privacy Policy
This Privacy Policy applies only to Clients; as used herein, “you” refers only to Clients using CareGiver360® (“Site” or “Services”). Generally, the information you exchange with your caregivers(s) through the Site or the Services is subject to the privacy policy of your caregivers(s). With respect to your “Protected Health Information” (as defined in the Health Insurance Portability and Accountability Act (HIPAA)), CareGiver360® acts as a “Business Associate” to your caregiver(s) and complies with U.S. Department of Health and Human Services (“HHS”) regulations relating to the electronic storage and transmission of personal health information. You should consult your caregivers(s) regarding their privacy policies that apply to your Protected Health Information.
Links to Third Party Web Sites
The Site may provide links to third-party web sites for your convenience and information. If you access those links, you will leave the Site. CareGiver360® does not control those sites or their privacy practices. We do not endorse or make any representations about third-party web sites. The personal data you choose to give to unrelated third parties is not covered by this Privacy Policy.
Information We Collect
CareGiver360® collects the following types of information based on the activity in the Site:
Personally Identifiable Information
CareGiver360® collects personally identifiable information only when you elect to register for and use the Services. When you register on the Site, we ask you to provide certain personally identifiable information in order to establish an account (name, address, telephone numbers, e-mail address, emergency contact information and personalized caregiving information). When you register for any Services that require payment of a fee, we collect your credit card information. Your caregiving provider or their associated staff may enter other information (such as therapy instructions or daily caregiving advice) into the CareGiver360® service, so that you may access that information at the Site.
Network/System Information
The Site collects certain standard computer information about your visit, such as the name of the Internet service provider, the IP address through which you access the Internet, the date and time of any requests to the site, and the Internet address of the referring web site. This information is used to help improve the Site, analyze trends, and administer the Site. This information is collected in anonymous form and is not linked to your account profile.
Cookies
A “cookie” is a small data file transferred by a website to your computer’s hard drive. Cookies provide a way to track the user across multiple transactions so information does not have to be repeated. CareGiver360® uses cookies when you visit the Site to identify your computer. CareGiver360® may use “permanent” cookies to improve the usability of the Site or to personalize aspects of the site based on a previous interaction with a certain function within the Site.
How Information is Used and Shared
Your credit card information is used for the purpose of paying your fees, if any. CareGiver360® does not share your information with anyone. Your personally identifiable information is authorized by you.
CareGiver360® operates in accordance with healthcare laws (e.g., HIPAA) and industry best practice policies, whereby information is shared with caregivers and providers that are responsible for or involved with your care. CareGiver360® believes that clients should always elect or acknowledge which caregiving providers and/or caregiving organization should have access to their information. CareGiver360® will not sell, rent or lease your personal information to others.
We will disclose information in response to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may disclose information, if we believe it is necessary to investigate, prevent or take action regarding suspected illegal activities or fraud, situations involving the physical safety of any person, violations of the Terms of Service, or as otherwise required by applicable law.
If our company or our assets are acquired by another company, that company will possess the personally identifiable information collected by us and it will assume the rights and obligations regarding your personally identifiable information as described in this Privacy Policy.
Keeping Information Secure
CareGiver360® is committed to protecting the information of our customers. To prevent unauthorized access or disclosure, to maintain data accuracy and to ensure the appropriate use of the information, CareGiver360® has in place reasonable physical and managerial procedures to safeguard the information we collect. This information is stored internally in a controlled, secure environment.
Access to this information is restricted to the account name and password established by the user at the time of registration. Once authenticated, you can then navigate within the application to view or modify your account.
We use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data such as credit card information. We use this industry-standard encryption technology when transferring and receiving your information. On the Internet, when you see either a solid key icon or a locked padlock icon at the lower portion of your browser window, this indicates that the site is secured through SSL encryption, which is designed to make the information unreadable by anyone but us. Pages requesting personal information should always have one of these icons. If you do not see one of these icons, please contact us.
However, no company, including CareGiver360®, can fully eliminate security risks associated with personally identifiable information.
